Article IX, Patio Construction Guidelines

1. All patios must be approved, in writing, by the Board of Managers prior to the commencement of construction.

2. Patio plans must be submitted in the form of a drawn diagram.

3. Patio plans must specify unit style (type) and end or middle unit placement.

4. Tenants submitting plans must have the homeowner’s written authorization.

5. Patios must not be more than sixteen (16) feet in length, measuring from the back wall of the unit. The patio must provide for a six (6) foot clearway between the rear of the patio and the rear edge of the lawn. Homeowners with backyards less than twenty-two (22) feet in length shall have a reduction in the length of the patio.

6. The patio must be the width of the unit, minus six (6) inches on each side. Patios must not be connected. The privacy fence, in its original position, must be considered the end of the unit.

7. No part may be more than six (6) inches above the ground. Homeowners with steeply sloping backyards may be limited in the size of their patios.

8. Patios must be built using bricks or patio blocks, set in sand or RCA, and held in place using treated 6x6 railroad ties or a “slurry mix”. No concrete may be poured. Colors should be red, green or natural, and not mixed.

9. No extension of the privacy fence is allowed. No additional fencing may be erected.

10. Planting of plants and shrubs is permitted around the perimeter of the patio. Shrubs may not be more than three (3) feet in height, and will be trimmed to that height by the homeowner. Plantings along the back of the patio must be included in calculating the clearway in section (5) of the guidelines.

11. The existing concrete patio and steps must be left intact.

12. Sprinkler heads and lines that must be moved to accommodate the patio must be moved by the condominium’s irrigation contractor, at the homeowner’s expense.

13. The homeowner shall be responsible for the cost of removing and replacing the patio should any utility lines sanitary septic, drainage and/or irrigation lines need to be serviced.

14. The homeowner shall be responsible for all upkeep and maintenance of the patio. 

15. The Board reserves the right to modify or add to the patio guidelines, and may do so upon reviewing individual patio plans.

16. Requests and diagrams should be sent to the Board of Managers or the Managing Agent.
